These General Conditions have been drawn up in accordance with the provisions of the Law 34/2002 on information society services and electronic commerce, Law 7/1998 on General Contracting Conditions , and other applicable legal provisions.

The use of the Portal and/or the acquisition of any of its products implies the acceptance as a User, without reservations of any kind, of each and every one of the General Terms of Contract, the General Terms of Use of the Portal as well as the Specific Terms that, where applicable, govern the acquisition. By using this website or placing an order through it, you agree to be bound by these Terms and by our Privacy Policy, therefore, if you do not agree with all of the Terms and the Privacy Policy, you must refrain from placing any order.

The Administrator informs that the procedures to carry out the acquisition of its articles are those described in these general contracting conditions, as well as any other specific ones that are indicated on the screen during navigation, so that the User declares to know and accept said procedures as necessary to access the products and services offered on the Portal.

Any modification and/or correction of the data provided by Users during navigation must be carried out according to the instructions included on the Website.

Products offered. Purchase system

The clauses listed below make up the “General Contracting Conditions”, with the purpose of regulating the acquisition, through www.lapromenade.es by users, of the products offered by THE ADMINISTRATOR in its online store. The User will have to consult, register and accept these conditions, before making the online purchase, understanding that access to the store as well as the purchase of any of the products offered will imply acceptance of these General Conditions of Contract. Specifically, for the acquisition of the products offered through the portal www.lapromenade.es , users who proceed to register must be over eighteen (18) years of age and must complete the instructions that appear in these General Conditions of Contract and that will require executing the following instructions, as well as any others that are included in the different screens of the Web: (a) Complete completion of the electronic form that appears at any time according to the purpose, following the instructions indicated therein; (b) Pressing the icon/button Confirmation of Order; (c) Receipt of registration confirmation in the User's email account.

On the other hand, the Administrator reserves the right to stop facilitating the acquisition, at any time and without prior notice, of any of the products offered on the Web.

The information appearing on this Site is current as of the date of its last update. THE ADMINISTRATOR reserves the right to decide at any time which Products are contained and offered to Users through the Web, so that it may update, modify or eliminate the content and elements that make up the Site, without prior notice, when it deems appropriate. Regarding the color of the garments that appears on the screen, you are advised that it may be subject to variations depending on the screen of your computer, and therefore we cannot guarantee that the colors that appear faithfully match it.
Without prejudice to the foregoing, THE ADMINISTRATOR makes every effort to ensure that the colours appearing on the screen are displayed as closely as possible to reality.

 

Purchasing procedure

To purchase the items you want, you must select them and add them to “Cart” by clicking on the corresponding icon.
The “cart” will contain the reference of the selected item, and its price, with an indication of the applicable taxes.
To place an order you must register, for which you will be asked for your necessary personal data, which will be incorporated into our database in order to process said order as well as facilitate the completion of new purchases at www.lapromenade.es. Likewise, you will be able to access your personal data and the information of all your orders. It is important that you indicate said data as accurately as possible, to avoid confusion or incidents in the delivery of the purchased items.
Once the order has been completed by filling in the relevant details, and before it is sent, a summary will be displayed identifying the item purchased, its total price (including shipping and taxes) and the shipping details. The order must be confirmed by clicking on the “Pay” button.
Once the transaction has been confirmed, you will be notified via the website of your order number so that you can track it at any time.

Form, Costs and Delivery Time

THE ADMINISTRATOR sends orders to its customers through various prestigious national and international express delivery companies. The delivery date at the User's address depends on the availability of the chosen product and the delivery area. The delivery time is 10 working days for orders delivered to the Peninsula, and 3 to 7 more working days for the rest of Spain. For orders delivered abroad, the delivery time will be one to two weeks. *The indicated delivery times are indicative.

During sales periods, delivery times in the Peninsula can be up to 5 working days.

Shipping costs appear on the website when placing the order and prior to order confirmation.

Delivery is deemed to have taken place when the product is made available to the Customer by the carrier and the recipient signs for receipt of delivery. It is the recipient's responsibility to check the products upon receipt and to make any justified reservations and claims.

Buyer Rights and Return Policy

For the first exchange in Portugal and Spain (including the Canary Islands, Balearic Islands, Ceuta and Melilla), the customer must return the item to us after giving notice by email to sales@lapromenade.es (shipping costs and, where applicable, customs charges that may arise will be borne by La Promenade). We will send a carrier to make the exchange (provided that the requested item is available). For subsequent exchanges, shipping costs and, where applicable, customs charges will be borne by the customer.

For the first exchange outside Spain and Portugal: the customer must return the item to us after giving notice by email to sales@lapromenade.es (shipping costs to the customer's address will be borne by La Promenade and, where applicable, customs costs will be borne by the customer). We will send a carrier to make the exchange (provided the requested item is available). For subsequent exchanges, shipping costs and, where applicable, customs costs will be borne by the customer.

The User may return any item purchased through the portal http://www.lapromenade.es as long as it is for the following reasons:

– Art. 102 of Law 3/2014 of March 27 grants the Client the right to return the requested order within a period of 14 days from receipt thereof, after notifying THE ADMINISTRATOR within that period, with a refund of the price paid for it .
– You may return the purchased item as long as the products have not been opened or used and retain their original seal or packaging. Returns will not be accepted if the product is not returned in perfect condition, with its original packaging and unused.
– The entire order must be returned, with all accessories and original packaging of the products. The product must be in perfect condition and in its original packaging. Otherwise, the customer must pay the direct costs of return.
– Pursuant to the law, returns of unsealed items will not be accepted, except in cases of defective merchandise.
– If the product is defective, the customer can also opt for a replacement of the product within these fourteen days.
– Returns due to defects caused during transport or shipping errors.

If the return is made after this period, or the item has been used, is damaged or does not have its original La Promenade packaging, your return cannot be accepted and you will not be entitled to a refund. Returns of items will only be accepted if they retain their original labelling and it has not been removed.

The customer will be responsible for the return costs, customs fees and local taxes. If the return costs are higher than the value of the goods to be returned, the remaining balance will be charged in the same way as the original payment.

Returns Costs Table (VAT not included)

If at the time of delivery it is visibly and clearly evident, without having to handle the shipping packaging or the product itself, that a product has defects caused by damage in transit or in the same way an error is evident in the merchandise received, the Customer must indicate this on the delivery note and notify THE ADMINISTRATOR by email at sales@lapromenade.es or by phone at (0034) 685 40 26 81, or may also contact us via WhatsApp within 24 hours of receiving the order in order to request the return of the affected product or products and thus the replacement with a new one or the refund of the price paid for it.

Defects caused during transport that are only noticeable after unpacking the product must be reported within the first 24 hours of receiving the order in the manner indicated above, indicating the order number, the damage caused to the product and requesting the return of the affected product and thus the replacement with a new one or the refund of the price paid for it. THE ADMINISTRATOR will examine it and inform you if you are entitled to a replacement. Returns will not be made for products that are not in the same condition as when you received them, or that have been used beyond the mere opening of the product. The return or replacement of the item will be made as soon as possible and, in any case, within 30 days following the date on which we send you an email confirming that the return or replacement of the non-compliant item is appropriate.

In these cases, THE ADMINISTRATOR will refund the purchase price within 30 days of receiving the User's communication requesting the refund. This will be done using the same payment method used to pay for the purchase, or by bank transfer to the account indicated by the User.

In the event that the returned product is out of stock, the customer may choose to exchange it for another of similar price and quality, or request a refund of the price paid for it.

Communications from THE ADMINISTRATOR to the User will be carried out in accordance with the data provided by the latter when registering on the Website. Applicable regulations require that part of the information or communications that we send to you be in writing. Therefore, you expressly accept the use of email as a valid procedure for sending all communications related to the use of the Website, recognizing for contractual purposes that any communication that THE ADMINISTRATOR sends to you for these purposes complies with the legal requirements of being in writing. Terms of payment

Products purchased through this portal will be paid for by the User on the Web, using a credit card (virtual POS). If the shipment is destined for mainland Spain, payment on delivery is also accepted. The User must pay the full amount of the products purchased, so the order will be valid once bank confirmation of the payment made has been received.

For payments by credit or debit card, the charge will be made online, that is, in real time, through the payment gateway of the corresponding financial institution, once it has been verified that the data communicated are correct. Force Majeure

Failure by either party to fulfil its obligations due to force majeure shall not entail any liability for either party. Fulfilment of the obligation shall be delayed until the event of force majeure ceases, so that either party may request termination of the contract, without any compensation, if the cause of force majeure continues.

 

Applicable Taxes

The prices of the products displayed on the website include the applicable Value Added Tax (VAT) and any other applicable taxes and will always be the current ones, except for typographical errors. The offers will be duly indicated on the screen.

Purchases to be delivered within the territory of any of the member states of the European Union will be subject to VAT.

Purchases to be delivered to territories of non-EU member states, the Canary Islands, Ceuta or Melilla will be exempt from VAT.

Applicable Legislation. Submission to Jurisdiction.

For any litigation or matter concerning the Website www.lapromenade.es, Spanish legislation will apply, and the Courts and Tribunals corresponding to the consumer's location will be competent to resolve all conflicts arising from or related to the use of this Website.
